In this document (the "Privacy Policy"), we inform you about the data we collect, the purpose for which we collect it, how we use it and the rights you have regarding the processing of your personal data.

 

Access to the sites managed by the company Pertinium (hereinafter, the "sites") or the use of their services implies full and unreserved acceptance by the user of this Privacy Policy, as well as the Terms of Use and the General Terms of Sale.

 

With regard to the sites, the Privacy Policy is valid for all the pages hosted on the sites and for the records of these sites. It does not apply to pages hosted by third parties to which Pertinium SRL may refer and whose privacy policies may differ. Pertinium cannot therefore be held responsible for any data processed on or by these sites.

1. Who are we?

1.1. Pertinium SRL, whose registered office is at Qualitis Science Park, avenue Jean Burgers 2, B-7850 Enghien, registered with the Banque-Carrefour des Entreprises under number 0802.628.874, is a company offering users of the www.bioparabolic.com website the possibility of ordering a selection of food supplements and balms.

 

1.2 We are concerned that our operational activities are carried out in accordance with current legislation, and in particular with Regulation 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, applicable since 25 May 2018 (hereinafter, the "GDPR").

 

1.3. We have appointed Jean-Noël Chamart, Director, as Data Protection Officer (more commonly known as "DPO"). The Data Protection Officer's duties at Pertinium are at least as follows:

 

- to inform and advise the controller or processor and the employees carrying out the processing on their obligations under current data protection legislation;

- to assist the controller in monitoring compliance with current legislation and Pertinium's internal rules on the protection of personal data, including the allocation of responsibilities, awareness-raising and training of staff involved in processing operations, and related audits;

- provide advice, on request, on the data protection impact assessment and check that it has been carried out;

- cooperate with the supervisory authority ;

- act as a contact point for the supervisory authority on matters relating to processing, including prior consultation, and carry out consultations, if necessary, on any other matter.

2. What personal data is collected?

2.1. We collect the information we deem necessary to provide the service. It is up to you to submit additional personal data to Pertinium. Here are the types of personal data we process, for the purposes mentioned in Article 3.

 

2.2. When the user accesses the www.bioparabolic.com website, the servers consulted automatically record certain data, such as :

 

- for services requiring authentication, identification data such as first and last name, title, e-mail address, date of birth, telephone numbers and addresses;

- the type of domain with which the user connects to the Internet ;

- the IP address assigned to the user (when they connect) ;

- the date and time of access to the www.bioparabolic.com site and other traffic data;

- location data or other communication data ;

- the pages consulted by the user on the www.bioparabolic.com website;

- the type of browser, platform and/or operating system used by the user;

- the search engine and the keywords used to find the site;

- browsing preferences.

 

Pertinium uses "cookies" to make browsing the www.bioparabolic.com website easier and to optimise technical management.

 

2.3. No nominative data enabling the user to be identified is collected by means of the cookies and servers consulted. This information is kept solely for statistical purposes and to improve the www.bioparabolic.com website.

 

2.4. The user also authorises Pertinium to record and retain, for the purposes mentioned in Article 3 :

 

- information voluntarily transmitted by the user for a purpose specified in the Privacy Policy or the General Terms and Conditions of the www.bioparabolic.com website or on any other communication medium used by Pertinium;

- additional information requested by Pertinium from the user in order to identify him or her or to prevent him or her from breaching one of the provisions of the Privacy Policy.

 

3. Cookie policy

This cookie policy describes the different types of cookies that Pertinium uses on the www.bioparabolic.com website and how you can configure these cookies. We maintain a strict data privacy policy and are committed to being transparent about the technologies used on the site.

3.1 What is a cookie?

3.2.3. Analytical cookies (statistics): These cookies are external and used to collect information about your use of the site, in order to improve the content of the site, make it more tailored to your needs and increase its user-friendliness.

Marketing cookies (from third parties) enable the site to send personalised advertising messages. We ask for your consent before placing these cookies.

 

3.2.4. Functional cookies (from third parties) such as those from social networks which allow you to share content and/or pages on the site. The www.bioparabolic.com website may also implement elements integrated with, for example, Youtube, LinkedIn, Twitter and Facebook. These are used to integrate social media on the website via plug-ins. These cookies may also be used for advertising purposes.

3.3. Is information from cookies passed on to third parties?

It is important to distinguish between two types of cookies:

4. Why do we process your personal data?

4.1. In general, Pertinium processes your data as part of its main activity, which is to sell a selection of food supplements and balms.

 

4.2. More specifically, we process your data for various purposes. For each processing operation, only the data relevant to the purpose in question is processed. Processing consists of any operation (manual or automated) on personal data. Pertinium collects, records and uses user data, in particular for the following purposes:

 

- to carry out statistical surveys;

- to analyse, adapt and improve the content of the site;

- to enable the user to receive messages ;

- to facilitate the provision and use of the site;

- to personalise the user's experience on the site;

- to keep them informed of changes to the site and its functions;

- for any other purpose for which the user has given his express consent;

- to canvass on its own behalf.

 

4.3. Pertinium may also process your data for marketing purposes:

 

4.3.1. For the purposes of marketing our services: by registering on the www.bioparabolic.com site, you agree that your contact details and information relating to your use of the site may be used to offer you additional products or services. These promotional offers may be communicated by e-mail or telephone. We will never send you promotional offers by text message (SMS). If you do not wish to receive commercial offers by e-mail or telephone, you can unsubscribe at any time by using the unsubscribe link in the e-mail or by contacting us at dpo@pertinium.com.

 

4.3.2. Internal business purposes: In order to improve our site and develop new products and services, we may use your personal data for internal data analysis, to study how our site is used, to help us diagnose problems and secure the service, to identify usage trends and to determine the effectiveness of promotional campaigns. For example, we may determine how long users spend on each page of the website and how they navigate the site. We will only use this information to improve our site.

 

5. Legal basis for processing personal data

Under European data protection legislation, any processing of personal data must be justified by a "condition" for processing. In the majority of cases, any processing will be justified on the grounds that:

 

- you have consented to this processing;

- the processing is necessary for the purposes of the contract concluded with you (for example, the creation of your user account or the delivery of your order);

- processing is necessary to comply with a relevant legal obligation; or

- processing is in our legitimate business interests, subject to your interests and fundamental rights.

 

6. Will Pertinium disclose my personal data to third parties?

6.1. Pertinium will not communicate your personal data to third parties, under conditions other than those specified in the Privacy Policy, in order to achieve the objectives referred to and defined in Article 3 or under the conditions in which the law obliges it to do so.

 

6.1.1. With our suppliers and service providers: we use the services of several recognised third parties, who carry out various tasks for us, under the protection of the appropriate agreements. Access to data may, in some cases, be granted to certain categories of external recipients, such as technical service providers, payment services, transporters, courier services, hosting providers, IT companies, legal advisers, communications agencies, expert assessors, research funding agencies and institutions hosting research projects.

 

For example, Pertinium uses leading third-party platforms to provide us with storage services, to assist us with marketing and advertising, analysis of online behaviour, development of new services, fraud prevention, security and handling of user support requests.

 

6.1.2. In certain legal circumstances or for the protection of privacy: when required by law or as part of legal proceedings, or for the prevention of fraud and cybercrime.

 

6.2. Disclosure of this information to the aforementioned persons must, in all circumstances, be limited to what is strictly necessary or required by the applicable regulations.

 

6.3. Pertinium only transfers data to a country outside the European Economic Area when this country ensures an adequate level of protection within the meaning of the legislation in force and, in particular, within the meaning of the GDPR, or within the limits permitted by the legislation in force, for example by ensuring the protection of data through appropriate contractual provisions.

 

6.4. Information controlled by Pertinium will be transferred or transmitted, or stored and processed, for example in other countries outside the country where you live, for the purposes described in this Privacy Policy. These data transfers are necessary to provide the services or to carry out the processing set out in the Privacy Policy. We use standard contractual clauses approved by the European Commission and rely on the European Commission's adequacy decisions in respect of certain countries. 7. User rights

7.1. You have the following rights:

 

- The right to be informed of the purposes of the processing and the identity of the data controller.

- Right of access: the user may at any time access the data that Pertinium holds on him or check whether he is included in the Pertinium database.

- Right of rectification: we take all reasonable steps to ensure that the data we hold is up to date. We encourage you to access your account from time to time or to check with us to ensure that your data is up to date. If you find that your data is inaccurate or incomplete, you have the right to ask us to rectify it.  

- Right to object: users may at any time object to the use of their data by Pertinium and its partners.

- Right of deletion: the user may at any time request the deletion of his/her personal data, with the exception of data that Pertinium is legally obliged to retain.

- Right to restrict processing: users may obtain a restriction on processing if they object to processing, if they dispute the accuracy of the data or if they consider that processing is unlawful.

- Right of portability: the user has the right to receive the personal data that he has communicated to Pertinium and may also ask Pertinium to transmit this data to another data controller.

 

7.2. In order to exercise their rights, users must send a written request, accompanied by a copy of the front of their identity card, to the data controller by e-mail to dpo@pertinium.com.

 

7.3. Pertinium will then do what is necessary to satisfy this request as soon as possible and in any event within one month of receipt of the request. If necessary, this period may be extended by two months, in view of the complexity and number of requests.

 

8. Minors

Persons under the age of 18 and persons who do not have full legal capacity are not authorised to use the www.bioparabolic.com site. Pertinium asks them not to communicate their personal data via the site or any other intermediary. Any breach of this provision must be reported immediately to the following address: dpo@pertinium.com

 

9. Security

9.1. Pertinium has taken the appropriate organisational and technical measures to guarantee a level of security appropriate to the risk and to ensure that the servers hosting the personal data processed prevent, as far as possible :

 

- unauthorised access to or modification of this data;

- inappropriate use or disclosure of such data;

- the unlawful destruction or accidental loss of this data.

 

9.2. Although we have undertaken to develop, implement, maintain, monitor and update a reasonable security programme in respect of such data, none of these programmes is infallible; in other words, not all risks can be reasonably eliminated and it cannot be assumed that the occurrence of any incident or breach would result from our failure to implement and maintain reasonable security.

 

9.3. Users undertake not to commit any act that may be contrary to this Confidentiality Policy or, more generally, to the law. You are responsible for the confidentiality of your password for access to the service. Pertinium asks you not to share your password with any third party. Pertinium asks you not to use the password you use for Pertinium for any other service.

 

10. Data retention

10.1. Pertinium retains users' personal data for as long as is necessary to achieve the purposes pursued (Article 3) and to provide the services in accordance with the General Terms and Conditions of Sale.

 

10.2. Retention periods may vary from one processing operation to another, depending on the purpose and the legal basis for the retention period.

 

10.3 Pertinium may also continue to hold certain personal data concerning the deregistered user, including any correspondence or requests for assistance addressed to Pertinium, in order to be able to respond to any questions or complaints addressed to it after the processing, to ensure the smooth running of the activities carried out by Pertinium and to comply with all applicable laws, in particular in tax matters or other legal requirements.

 

11. Complaints to the supervisory authority

Users are informed that they have the right to lodge a complaint with the Data Protection Authority (DPA), whose contact address is as follows:

12. Validity of clauses, applicable law and jurisdiction

12.1. Pertinium's failure to avail itself, at a given time, of a provision of the Privacy Policy may not be interpreted as a waiver of its right to subsequently assert its rights under the Policy.

 

12.2. The nullity, lapse or unenforceability of all or part of one of the preceding or following provisions will not result in the nullity of the entire Privacy Policy. The wholly or partially null, void or unenforceable provision will be deemed unwritten. Pertinium undertakes to replace this provision with another that pursues, as far as possible, the same objective.

 

12.3. The validity, interpretation and/or execution of the Privacy Policy are subject to Belgian law, to the fullest extent permitted by the applicable rules of private international law.

 

12.4 In the event of a dispute relating to the validity, interpretation or execution of the Privacy Policy, the Courts and Tribunals of the judicial district of Brussels shall have exclusive jurisdiction, to the fullest extent permitted by the applicable rules of private international law.

12.5. Before taking any steps aimed at the judicial resolution of a dispute, the user and Pertinium undertake to try to resolve it amicably. To this end, they shall first contact each other, before resorting, where appropriate, to mediation, arbitration or any other alternative dispute resolution method.
